Tesla Model S caught fire after collision, and the owner's claim for 3.37 million yuan was rejected

According to IT Home on April 7, on the evening of February 17, 2023, Mr. Liu, a Tesla Model S owner in Shenzhen, encountered a thrilling scene. When he was driving the vehicle at a low speed, the bottom of the vehicle scratched the bricks that were protruding from the road and caught fire. Fortunately, the property security guards called the police in time and assisted in extinguishing the fire. The firefighters who arrived later controlled the fire and did not cause any greater losses. Mr. Liu then sued Tesla Auto Sales Service (Shenzhen) Co., Ltd., requesting a refund of the purchase price and a three-fold compensation of RMB 3.37 million in accordance with the Consumer Rights Protection Law.

According to Southern Metropolis Daily, the first instance civil judgment of the case was recently announced. The court held that Mr. Liu did not prove that the vehicle had a quality defect and that the defect had a causal relationship with the consequences of the damage . Evidence submitted by Tesla shows that the vehicle involved has obtained relevant quality certification during import and sale, and is a qualified product. Therefore, the court rejected all Mr. Liu's lawsuit.

Regarding the first-instance judgment, Mr. Liu expressed his difficulty in accepting it and said that he would file an appeal in accordance with the law. He emphasized that the vehicle only scratched at low speed when the accident occurred but exploded instantly, which did not meet normal vehicle safety standards . He also mentioned that Tesla originally promised that the battery would be warranty and that the vehicle in the accident was still within the warranty mileage of 240,000 kilometers, but after the accident, consumers were responsible for proving that the product was problematic.

In addition, IT Home noticed that Mr. Liu pointed out that the car was produced in 2014, and the national standard for electric vehicle quality released by China in 2015 clearly stipulates the thickness of the steel plate of the electric vehicle and the inability to burn and catch fire within 60 seconds after the battery is hit. "Tesla cannot apply to the 2014 vehicle according to the 2015 standard, and forcibly explains that its vehicle meets the standards. We found that according to the national standard, Tesla's battery chassis protection strength and the combustion and explosion of the battery do not meet the standards."

Mr. Liu had entrusted two appraisal institutions in Guangdong Province to conduct judicial appraisal of product quality, but for various reasons, both appraisal institutions refused to appraise. Mr. Liu believed that this made it more difficult for consumers to protect their rights.

Tesla did not respond to the problems reported by Mr. Liu. Its customer service said that all vehicles have undergone strict safety tests and suggested "focusing on the technical updates of the official website."
