At a press conference held on April 25, Huang Haihua, spokesperson of the Legal Affairs Committee of the Standing Committee of the National People's Congress, introduced the relevant situation of the draft law to be reviewed at this meeting.

  Compilation of the Ecological Environment Code system to integrate more than 30 ecological environment laws

  The draft Ecological Environment Code is to be submitted for the initial review of this Standing Committee meeting.

  "The compilation of the Ecological Environment Code has a good foundation, and the conditions are ripe and timely." Huang Haihua said that compiling the Ecological Environment Code will confirm the theoretical, institutional and practical achievements of ecological civilization construction since the 18th National Congress of the Communist Party of China in a systematic and codified manner. It is of great significance to promote the construction of a beautiful China on the track of the rule of law, promote the modernization of harmonious coexistence between man and nature, and promote the joint construction of a clean and beautiful world.

  The main contents of the draft include: improving general institutional norms in the field of ecological environment, integrating and optimizing legal system norms for pollution prevention and control, leading and coordinating legal system norms for ecological protection, making principled and leading provisions on green and low-carbon development, climate change response, carbon peak and carbon neutrality, etc., and improving the legal responsibility system in the field of ecological environment.

  Huang Haihua introduced that the Ecological Environment Code comprehensively considers the ecological environment elements such as atmosphere, water, and soil, adheres to the integrated protection and systematic management of mountains, rivers, forests, fields, lakes, grasslands and sands, and coordinates the promotion of carbon reduction, pollution reduction, greening expansion and growth, and solves the prominent problems that restrict high-quality development and high-level protection in the ecological environment.

  There are more than 30 effective ecological and environmental laws in my country. How can the draft Ecological and Environmental Code systematically integrate these laws?

  Huang Haihua said that the compilation of the Ecological Environment Code currently adopts a moderate codification model, and deals with more than 30 effective ecological environment laws in sub-situation: First, comprehensive laws on ecological environment protection and laws on pollution prevention and control will be included in the code, and compiled and revised according to the new situation and new requirements. The second is to include the current legal system norms related to ecological factors such as river basins, regions, natural resources, biodiversity, and ecological systems, circular economy, energy conservation, etc., and choose the key points to be included or reflected in the code to maintain a certain degree of openness and compatibility. Third, appropriately consider the legal needs of green and low-carbon development, climate change response, carbon peak and carbon neutrality, fill the legal gaps, and make some principled and leading provisions to reflect the contemporary and forward-looking nature of the code.

  The third draft of the draft of the Private Economy Promotion Law further enriches the relevant measures to support the development of the private economy

  At this Standing Committee meeting, the draft Law on Promotion of the Private Economy will usher in the third review.

  "The draft has been relatively mature after repeated revisions. It is recommended to review and issue it as soon as possible after further revision and improvement."

  Huang Haihua introduced that members of the Standing Committee and all parties generally believe that it is necessary and of great significance to formulate the Law on Promoting the Private Economy, implement the basic principles, policies and important measures of the Party and the State for the development of the private economy into legal norms, integrate it with the provisions of the Constitution and the Party Constitution on the basic socialist economic system, integrate it into the socialist legal system with Chinese characteristics, and give full play to the role of the rule of law in consolidating the fundamentals, stabilizing expectations, and benefiting the long-term.

  According to reports, according to the review opinions of the Standing Committee of the National People's Congress and opinions from all parties, the third draft of the draft of the Private Economy Promotion Law further enriches relevant measures to support the development of the private economy, promotes strict, standardized, fair and civilized law enforcement, and optimizes the legal environment for the healthy development and high-quality development of the private economy.

  The second draft of the revised draft of the Arbitration Law intends to further improve the foreign-related arbitration system

  In November 2024, the 12th meeting of the Standing Committee of the 14th National People's Congress reviewed the draft amendment to the Arbitration Law. After the initial review of the draft amendment to the Arbitration Law, the Legislative Affairs Committee of the Standing Committee of the National People's Congress listened widely to opinions from all parties and jointly studied the main issues involved with relevant parties.

  "The second draft of the revised draft plans to further improve the foreign-related arbitration system, strengthen arbitration supervision, improve the relevant systems for courts to support arbitration, etc., actively connect with internationally accepted rules, improve the credibility and international competitiveness of arbitration, and better serve high-quality development and high-level opening up to the outside world." Huang Haihua said.

  According to reports, the second draft of the revised draft plans to mainly revise the following aspects: strengthen arbitration supervision and improve the credibility of arbitration; improve the arbitration committee system and optimize the conditions for serving as an arbitrator; improve the foreign-related arbitration system and strengthen foreign exchanges and cooperation with arbitration; improve the relevant systems for the court to support arbitration, and clarify the parties' preservation applications submitted by the arbitration committee for property, behavior, and evidence, and the people's court shall promptly handle it in accordance with the law.

  In addition, the press conference also introduced the draft amendment to the Infectious Disease Prevention and Control Law, the draft Atomic Energy Law and other related situations, and reported on the progress of the legislative work plan of the Standing Committee of the National People's Congress in 2025.
